Specific deliverables and service levels are detailed in applicable Master Service Agreements (MSA) or statements of work (SOW) executed between ALBORISS and our clients.
2. User Accounts & Security
To access certain features of the Services, you may be required to register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You must provide accurate, current, and complete information during the registration process.
- You agree to immediately notify ALBORISS of any unauthorized use of your account or any other breach of security.
- ALBORISS will not be liable for any loss or damage arising from your failure to comply with these security obligations.
2.1 Enterprise Registration
For enterprise deployments, account administration is typically managed by a designated administrator within your organization. Administrators are responsible for provisioning and de-provisioning user access in accordance with their organizational policies and our licensing terms.
3. Intellectual Property Rights
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by ALBORISS, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Usage Restriction
You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without explicit written consent from ALBORISS.
4. Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL ALBORISS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
5. Governing Law and Jurisdiction
All matters relating to the Services and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the jurisdiction specified in your underlying enterprise agreement, without giving effect to any choice or conflict of law provision or rule.
